For Meeting of November 3, 2011
Here goes the first attempt at a reduced paperwork meeting packet. I'm anxious to see how this works.
We have a relatively brief agenda, but the executive session and budget workshop may take some time.
Minutes – The minutes are in this packet. Please do your usual splendid written edits if possible or needed.
Warrant 9 – The hard copy of this is eliminated from the packet, but posted on line. As of this writing, the warrant is relatively small, though there are several bills from Richard McMullen for road work and the net of the 1st plowing installment for October on here. As the warrant is updated, the on-line version of this and the financial reports will be updated.
Cash & Budget Reports – The latest report as of the packet date will be in your packet, but again, this will be updated on line and the new version at your place in the table the night of the meeting.
Fee Schedule Public Hearing – The public hearing notice is posted on line. The gist of the hearing and subsequent action is to act on the Code Enforcement Officer's recommendation that a $10/sign fee be imposed under the Building and Land Use Ordinance.
Clamshell Alley Trimming Concerns – I e-mailed you the concern and I followed that up with a visit to the road. The brush has been removed, though one resident was not satisfied with how fast she could leave her driveway Monday morning while they were cleaning up the cuttings. The bush in question is indeed gone. I spoke with Richard McMullen, and he said that after cutting back the bush that was sticking in the road, the remainder was right in front of the entrance to the Cobb House (presently vacant) and looked quite ugly so he cut the rest. The bush was in the right of way, and a 2 nd bush next to it was just trimmed back. Overall, the cutting job looked pretty good to me, and the trees will definitely be out of the way for quite a while. No action was requested that I could tell. I think Richard got an earful during the trimming job from the neighbors as well.
Town of Trenton Meeting – Remember we'll be meeting with Trenton's Recycling Committee on November 2, 2011 at 7PM at their town office. I plan to attend. Any Selectmen who would like to go with me is welcome. I'll see if Bill Fennelly wishes to go.
Trespass Complaint – I did up a letter for Jo to sign, which she did, and that has been sent to the alleged offender. As of this writing, there has been no feedback, but the letter has not yet been received.
Executive Session – The individual who requested the meeting would qualify under 1MRSA §405(6) (A) as follows: Discussion or consideration of the employment, appointment, assignment, duties, promotion, demotion, compensation, evaluation, disciplining, resignation or dismissal of an individual or group of public officials, appointees or employees of the body or agency or the investigation or hearing of charges or complaints against a person or persons subject to the following conditions:
(1) An executive session may be held only if public discussion could be reasonably expected to cause damage to the individual's reputation or the individual's right to privacy would be violated;
(2) Any person charged or investigated must be permitted to be present at an executive session if that person so desires;
The person being complained about has requested the meeting be in executive session. I'm not an attorney, but I don't see any problem with proceeding under this statute.
There are no other matters for executive session at this time.
Budget Workshop – The Budget Committee meets on Monday, November 7, 2011 at 6:30 PM. I've drafted up the revenue, road, code enforcement, and capital needs budgets and those will be in your packets for more work before being presented to the Budget Committee. The fire department has presented its preliminary budget to me and I'll be drafting up the explanation for that as well.
