	Lamoine Board of Appeals Minutes of February 4, 2008 - (Draft, subject to revision)

Deputy Town Clerk Stu Marckoon called the meeting to order at 7:02 PM

Present were: Appeals Board Members Reginald McDevitt, James Crotteau, John Wuorinen, Hancock “Griff” Fenton, Jay Fowler, Merle Bragdon, Nicholas Pappas (arrived 7:25 PM) and Adm. Asst. Stu Marckoon.

Introductions – Board members introduced themselves to each other.

Officers – Chair – Mr. Fowler nominated Mr. Fenton to serve as chair through June 30, 2008. Mr. McDevitt 2 nd . Vote in favor was 5-0 (Fenton abstained, Pappas not present)

Vice-Chair – Mr. McDevitt nominated Mr. Pappas as vice-chair. Mr. Fowler 2 nd . Vote in favor was 6-0 (Pappas not present)

Secretary – Mr. Crotteau moved to have Stu Marckoon continue as the Board's Secretary. Mr. Fowler 2 nd . Vote in favor was 6-0 (Pappas not present)

Procedures – The board reviewed a memo from Mr. Marckoon outlining some of the considerations the Appeals Board has to make when reviewing a case. Mr. Pappas arrived during this discussion. Among the areas discussed:

• Meeting Notification – members said e-mail inquiries for scheduling were fine. Mr. Marckoon said he would follow with written agendas mailed to the Board.
• Administrative vs. de novo hearings – Mr. Wuorinen briefly reviewed the difference.
• Conflicts of Interest
• Seeking Legal Advice – Mr. Wuorinen urged to board that if legal advice is needed, it should be sought. Mr. Crotteau said his presence on the board was not as a town attorney, but he could certainly help identify times when it would be appropriate to seek counsel. Mr. Marckoon said it often gets sticky as to whom the town attorney is representing.
• Relations with the Planning Board – A brief discussion took place about the documentation now in place from the Planning Board.

There being no further business to discuss, the meeting adjourned at 7:35 PM
