MInutes of June 13, 2011 - Draft, subject to correction
Chairman Hancock “Griff” Fenton called the meeting to order at 7:00 PM
Present were: Appeals Board members John Wuorinen, Hancock “Griff” Fenton, Merle Bragdon, Jay Fowler; Secretary Stu Marckoon, and Michael Ross (attorney for Gott)
Minutes of June 6, 2011: Mr. Fowler moved to approve the minutes. Mr. Fenton had one spelling error to correct on page 4. Mr. Bragdon 2nd . Vote in favor was 4-0.
Gott v. Planning Board Findings & Conclusions – Chairman Fenton said the Board went and did it so there was no question about what was done and what the Planning Board was going to receive from the Appeals Board. He gave a very brief summary of the four items of the appeal and what the Appeals Board did with each of them.
Mr. Wuorinen said he was disappointed with the results of the re-vote. He said he didn't understand why it was necessary, and believed it was not necessary in regard to Site Plan Review Ordinance review criterion J16. Chairman Fenton said the Planning Board said the reason that item J16 was not approved was that in the motion the ordinance was vague. He said the Planning Board felt that vagueness was not an issue the Appeals Board should undertake. Mr. Wuorinen said it didn't need to be discussed because it's clear how the results came out in the findings of fact. Chairman Fenton said the Planning Board wanted something more concrete. He said it didn't change any of the issues.
Mr. Wuorinen moved to approve the revised findings of fact and conclusions of laws. Mr. Bragdon 2nd . Vote in favor was 4-0, members signed the revised findings.
Other – Chairman Fenton asked when the election of officers was. Secretary Marckoon said it would be after July 1st .
Mr. Fowler asked if this was going to end up in court. Mr. Ross said if anyone is taken to court, it would be the Planning Board. A very brief discussion followed.
There being no further business, the meeting adjourned at 7:10 PM
