Minutes - May 29, 2018

 

 

BOA members present:  Griff Fenton, Jon VanAmringe, Jay Fowler, Larissa Thomas, and Michael Jordan

 

Alternate members present: Karen Hood and Brett Jones

6:30   Meeting called to order by Mr. Fenton

 

BOA members Mr. Fenton, Mr. VanAmringe, Mr. Fowler, Ms. Thomas and Mr. Jordan will participate in Mr. Young’s appeal

 

Discussion of where Mr. Young’s home sits on the property, distances of the home and proposed garage to the road, septic tank and field and property lines were given. Mr. Fenton explained the 4 standards of a variance that all must be met to be given a variance.

 

Motion:

     1: We deny that the applicants land in question cannot yield a reasonable return unless a variance is granted.   Mr. Fowler made the motion.  Mr. Jordan 2nd      5-0

 

     2: We deny that the applicant need for a variance is due to the unique circumstances of the property and not to the general condition in the neighborhood.    Ms. Thomas made the motion.  Mr. VanAmringe 2nd    Vote 5-0

 

     3:  Not applicable     Mr. VanAmringe made the motion.   Mr. Fowler 2nd    Vote 5-0

 

     4: The hardship is not the result of action taken by the applicant or a prior owner.  Mr. Jordan made the motion.   Mr. Fowler 2nd    Vote 5-0

 

Moved onto the Harold MacQuinn, Inc. appeal, Findings of fact & Conclusions of Law

 

Mr. Fenton, Mr. VanAmringe, Mr. Fowler and Mr. Jordan will participate in the Harold MacQuinn, Inc. appeal.

 

Motion:  To accept the written Findings of Fact and Conclusions of Law and the decision of the BOA as amended, granting the appeal of the Planning Board Nov 14, 2017 decision by Harold MacQuinn, Inc.

Mr. VanAmringe made the motion.  Mr. Jordan 2nd    Vote 4-0

 

Next meeting will be held on June 5, 2018 at 6:30PM       (since changed to June 19, 2018)
