Minutes of the Lamoine Board of Appeals
April 13, 2004

Secretary Nick Pappas called the meeting to order at 7:03 PM

Present were Appeals Board members Chris Tadema-Wielandt, Nick Pappas, Jay Fowler, John Wuorinen; Administrative Assistant Stu Marckoon, Planning Board members Gordon Donaldson, Cece Ohmart, Melody Havey, Michael Garrett, Stuart Branch; members of the public Dennis and Gerald Ford, Kate Berry and Ken Smith.

Selection of Officers – John Wuorinen nominated Chris Tadema-Wielandt as chair. Jay Fowler 2nd. Vote in favor was 3-0.

Mr. Pappas said he would like to withdraw as secretary, though he would like to continue on the board. There was discussion as to whether an alternate could be the secretary. Mr. Wuorinen moved to defer selecting a secretary until one or more alternates are appointed. Mr. Fowler 2nd. Vote in favor was 4-0.

Mr. Wuorinen nominated Warren Craft as the vice-chair. Mr. Pappas 2nd. Vote in favor was 4-0.

Stu Marckoon said he’s not sure that the secretary actually has to be a board member and offered to serve as the secretary during the upcoming Pettegrow meeting(s).

Alvarez et al vs. Pettegrow – Mr. Tadema-Wielandt said there are two appeals involving the same parties to hear now, and it would seem to make sense to consolidate the cases and hear both at once. A short discussion followed. Former Board chair Melody Havey said she would suggest doing the same thing. Mr. Tadema-Wielandt said he doubted there would be arguments from either party against that.

Mr. Tadema-Wielandt said he has a concern that the Shoreland Appeal was to have been heard within 35-days, and it’s now 47-days since the filing. He said he would contact both counsels and set a date. He said it would be best to arrange a meeting as soon as possible. Mr. Fowler agreed, saying this matter has been dragging on. Mr. Tadema-Wielandt said it’s not fair to both parties that it be delayed.

There was a discussion of possible dates. The Board agreed it would try for Thursday, April 22nd. Stu said he would post the notice and advertise it once in the Bangor Daily News after waiting to hear from Mr. Tadema-Wielandt if the date is agreeable to both parties. The hearing would start at 5:00 PM. Stu said he would get the materials to the Alternate members once they’re appointed.

Other – Mr. Wuorinen moved to approve the minutes of October 28, 2003 and November 7, 2003 as presented. Mr. Pappas 2nd. Vote in favor was 3-0, Mr. Fowler abstained.

There being no further business, the meeting adjourned at 7:18 PM
