Lamoine Board of Assesors

Minutes of April 14, 2010

The meeting came to order at 7:00 PM

Present were: Assessors Jane Fowler, Terry Towne, Michael Jordan

Minutes Approval of the previous minutes was postponed

Hartline Family Abatement Request (Map 1 Lots 33, 34) - As a matter of background, Old Point, Inc. which is owned by the Hartline Family, had been in discussions with Maine Coast Heritage Trust's project manager about a possible donation. Assessor Towne is employed by Maine Coast Heritage Trust and recused himself from any participation in the Board of Assessors discussion of all issues surrounding these lots. He said he did not wish to be perceived as having a conflict of interest. Negotiations have now broken off with Maine Coast Heritage Trust.

Mike moved to find that there was no conflict of interest by having Mr. Towne participate in the board discussion. Jane 2 nd .

The board reviewed at great length the abatement requests and other similar parcels.

Terry moved to deny the abatement request for Map 1 Lot 33. Mike 2nd . Vote in favor was unanimous . The reason for denial was that the lot is assessed consistently with other similar lots in town.

Terry moved to deny the abatement request for Map 1 Lot 34. Mike 2nd . Vote in favor was unanimous . The reason for denial was that the lot is assessed consistently with other similar lots in town.

A letter will be prepared on April 15, 2010 to be sent to Old Point, Inc. with an explanation of the above denials.

Tree Growth Program Application The Board was unable to approve a tree growth application as the records indicate that the parcel did not qualify under 36 MRSA § 574B and Property Tax Bulletin 19, page 2, section 4(F). The application was submitted by Dennis and Nancy Ford, Map 8 Lots 19-1 and 19-2. The reasons for denial were

  1. The two lots cannot be combined into one application
  2. The two lots are not in the same ownership.
  3. Each lot by itself does not qualify because it lacks the minimum acreage requirement.

The board was not able to complete any other items on the printed agenda.

The next meeting date will be set following Terry's return on May 10th

The meeting adjourned at 9:30 PM.
