Lamoine Planning Board Minutes

July 3, 2007

The meeting was called to order by Chairman S. Branch at 7:03 pm.

Board Members Present: S. Branch, G. Donaldson, J. Gallagher, M. Garrett, M. Jordan, C. Ohmart

Members of the Public in Attendance: L. Ahlblad, K. Barbee, K. Berry, C. Brann, Y. Brann B. Brooks, K. DeFusco, J. Fowler, L. Harmon, C. Johnson, B. Jones, J. Kiser, T. Ring

Minutes of June 5, 2007. The minutes were accepted as presented.

CEO Reports: A lengthy discussion ensued regarding a complaint filed by J. Fowler concerning an abutting goat farm. The upshot of the discussion was that B. Brooks will submit a copy of a letter regarding drainage singed by a licensed engineer and B. Brooks will request that the Department of Agriculture inspect lower field drainage – preferably with J. Fowler in attendance. The CEO informed the Board jurisdiction for the complaints raised by J. Fowler resides with the State Department of Agriculture – NOT the Planning Board.

OLD BUSINESS

1. Completeness Review – Subdivision & Site Plan Applications, K&T Rentals, Map 8, Lot 12-A

Subdivision application. On motion by M. Garrett, seconded by J. Gallagher this application was deemed complete with these two listed conditions attached:

Site Plan Review Application. On motion of M. Garrett, seconded by J. Gallagher, this application was deemed complete with these two listed conditions.

Both applications were unanimously approved with conditions.

A Public Hearing is scheduled for the Board's July 31, 2007 meeting a 6:30 pm.

2. Completeness Review – Site Plan and Construction permits. Town of Lamoine . Salt/sand shed. Map 3, Lot 1.

Site Plan Review Application. On motion of G. Donaldson, seconded by C. Ohmart, this application was deemed complete with these listed conditions:

On a motion by M. Garrett, seconded by C. Ohmart, the application was deemed complete with the conditions stated. Motions for the completeness of both reviews were passed unanimously.

Commercial (Municipal) Building Permit application. On motion of M. Garrett, seconded by J. Gallagher, this application was unanimously accepted as complete.

The Planning Board is very much concerned about any ‘commercial” use of the sand stored in this shed. Commercial standards contained in the Ordinance were waived on the grounds this is a public building. Should the owner of the sand/salt contained therein sell to private contractors for use outside Lamoine, the Board may seek to initiate a violation. Selectman B. Jones is working to add an amendment to this effect to an already signed contract.

A Public Hearing is set for 6:40 pm on July 31, 2007.

3. Completeness Reviews – Subdivision & Site Plan Applications – JWJLLC, Map 4, Lot 6

Subdivision application. On a motion by M. Garrett, seconded by J. Gallagher the subdivision application was deemed complete with one condition.

b. Site Plan application. On a motion by M. Garrett, seconded by G. Gallagher, the application was deemed complete pending satisfaction of two conditions.

Motions for both permit applications were approved unanimously. A Public Hearing is slated for 6:50 on July 31, 2007

NEW BUSINESS

Commercial Building Permit – Pre-Application. B. Brooks. Map 4, Lot 24-2.

B. Brooks seeks to build a 48' x 31' barn for the storage of hay on property leased from an abutting neighbor. On a motion by S. Branch, seconded by C. Ohmart, the pre application was found to be complete pending satisfaction of two conditions. The conditions are:

The above stated motion a passed unanimously. A Site Visit is scheduled for 4:30 pm on Wednesday, July 11, 2007. Board members convene on site.

OTHER BUSINESS

  1. D. Ford requested and received from the Board, permission to use some discretion in applying ordinance stated sign standards. For small, non commercial signs, the fee and application procedure may be waived.
  2. G. Donaldson reported on his work to “co-ordinate” overlapping and confusing requests for information contained in the Subdivision and Site Plan Review applications.
  3. Election of Planning Board Officers. It being that time of year, the Board made the following nominations for Board offices:

All were duly seconded and unanimously elected.

Tuesday, July 31, 2007. PLEASE NOTE!!!. The “August” meeting of the Planning Board will be held on July 31, 2007. The reason for this date change is to guarantee a quorum for items in need of action.
