PUBLIC HEARING 

Public Hearing: Chairman S. Branch called the public hearing to order at 6:35 pm. M. Garrett summarized proposed changes to the Shoreland Zoning Ordinance to be presented at Town Meeting on April 2, 2008. Following acceptance of changes to this Ordinance at Town Meeting in March, 2007, the State Department of Environmental Protection reviewed the Ordinance as required by law. The review resulted in their proposing changes to make the Ordinance consist with State requirements. The Town has little choice but to incorporate these changes no later than July 1, 2009.

Copies of the changes are available at Town Hall and on the Town Web Site.

M. Garrett moved and M. Jordan seconded a motion to close the hearing at 6:50pm.

MARCH 4TH MEETING AGENDA 

Chairman S. Branch called the meeting to order at 7:00 pm. 

Minutes: The minutes of the Board's February 5, 2008 meeting were presented. Two amendments were offered.

1. In referring to a Commercial permit pre-application for J. & L. Karst, the minutes erroneously stated the application was accepted as complete with conditions. The motion corrected “application” to read “pre-application”.
2. A listed condition of this permit stated need for a statement testifying to the impact of the proposal on wildlife. There being no such requirement in the pre-application, this condition was stricken from the record.

CEO Reports: The reports were accepted and placed on file.

CONSERVATION COMMISION 

L. Tadema-Wielandt explained three active Conservation Commission initiatives.

1. The 2007 Conservation Commission Conservation Award is awarded posthumously to the Reverend Ellis Jordan Holt.
2. The Get-Wet Water program will sponsor a demonstration of the water testing and evaluation techniques employed in their project. The demonstration will be held at the Lamoine School on March 12 th at 7:00 pm. All are invited to attend AND to bring a cup (sample) of unfiltered water for testing.
3. The Commission is on the eve of putting the “finishing touches” on a proposed Aquifer Protection Overlay Zoning Ordinance. They will present their draft to the Planning Board in hopes it can be studied and presented to the Town in June.

OLD BUSINESS 

•  Subdivision Application – Completeness Review. S. & R. Joy. Map 4, Lot 55-1. With no one present to advance material for review, this item was passed over.

•  Commercial Building Permit Application – J. & L. Karst. Map 4, Lot 7. Following a discussion of the review criteria, M. Garrett moved and G. Donaldson seconded a motion to find the application complete with two conditions. The vote was unanimous.

The conditions are:

•  The applicants are to submit a plan showing how traffic will be routed during hours of operation.

•  The application fee needs be paid.

A Public Hearing is scheduled for 6:30 pm on Tuesday, April 8, 2008 at Town Hall.

NEW BUSINESS

None was presented on the agenda.

OTHER

D. Grasso presented the Board with this question:

“Does the public have a ‘right' to attend a Planning Board site visit and walk the land with an applicant and the Board?” S. Marckoon will seek an answer from the Maine Municipal Association.
