Minutes of the Lamoine Planning Board

May 6, 2008

Chairman S. Branch called the meeting to order at 7:00 pm.

Board Members Present: S. Branch, G. Donaldson, J. Gallagher, M. Garrett, M. Havey, M. Jordan, C. Ohmart

Members of the Public in Attendance: R. Cyr, K. DeFusco, R. Joy, S. Marckoon, J. McIntosh, S. Roberge, S. Salsbury, J. Tower.

Minutes, April 8, 2008. The minutes of April 8, 2008 were accepted as corrected – by adding the letter ‘T' in front of “he”.

CEO Reports : The reports were accepted and placed on file. 

OLD BUSINESS

•  R. Joy, Raccoon Hallow, Map 4, Lot 55-1 – an eleven lot subdivision beyond Pasture Way . The identification of an active eagle's nest prompted the developers to reconfigure subdivision lines. R. Joy will present to the Board in future, a new application reflecting proposed changes.

•  Renewal of Gravel Pit Permits.

•  RF Jordan, Map 3, Lot 4. M. Garrett moved and G. Donaldson seconded a motion to renew the permit with an expiration date of September 30, 2010. The vote was unanimous

•  Harold MacQuinn, Map 9, Lot 13, Map 20, Lot 12. M. Garrett moved and C. Ohmart seconded a motion to renew the permit with an expiration date of September 30, 2010. The vote was unanimous

•  Harold MacQuinn, Map 7, Lot 7 ; Map 7, Lot 9. M. Garrett moved and C. Ohmart seconded a motion to renew the permit with an expiration date of September 30, 2010. The vote was unanimous

•  Harold MacQuinn, Map 3, Lot 42 . M. Garrett moved and G. Donaldson seconded a motion to renew the permit with an expiration date of September 30, 2010. The vote was unanimous.

•  Harold MacQuinn, Map3, Lot(s) 31 & 33 . M. Garrett moved and G. Donaldson seconded a motion to renew the permit with an expiration date of September 30, 2010. The vote was unanimous.

•  J. W. Goodwin, Jr. Map 1, Lot 75. G. Donaldson moved and J. Gallagher seconded a motion to extend the life of the existing permit one month to allow a site visit before final approval. The vote was unanimous.

•  J. W. Goodwin, Jr., Map 4, Lot 41-1a. G. Donaldson moved and J. Gallagher seconded a motion to extend the life of the existing permit one month to allow a site visit before final approval. The vote was unanimous.

A Site visit to both Goodwin pits is scheduled for Saturday, May 10, 2008. Board members to assemble at the Town Hall at 7:30 am.

Some of the above Gravel Pit renewal applications and others in addition, have been filed one or more months after permit expiration. The result has been a need for the Board to grant six to eight month “extensions” to allow for site visits free of a snow groundcover. By consensus the Board is of a mind to require renewal permit applications to be filed in timely manner. Failure to do so could lead the Board to request the Board of Selectmen to levy fines for operating pits without permit.

•  Subdivision application and Site Plan Review pre-application – W. Wright/S. Salsbury, Map 4, Lot 34 – Partridge Cove Estates. The developers presented an eleven lot subdivision plan with several “remaining lands” areas to be retained by W. Wright. The question is: Do “remaining lands” retained by the developer (who does NOT reside on the property) constitute one or more lots in addition to the eleven “officially” put forth? Having sought an opinion from the Maine Municipal Association's Legal Department and after much discussion, the Board unanimously concludes this subdivision to be at least twelve lots subject therefore to greater set asides of open space.

Based upon this finding, no further action was taken on the subdivision application. The Board went on to consider the Site Plan pre-application. On motion of J. Gallagher, seconded by C. Ohmart, the Board accepted the pre-application as complete with two conditions. The conditions are:

•  Site Plan Review pre Application – Lamoine State Park . R. Cyr, J. McIntosh and S. Roberge, state employees associated with the project, explained this combined Group Shelter, Parking Lot and Dumping Station proposal. The Board reviewed the Site Plan pre-application. M. Garrett moved and C. Ohmart seconded a motion to approve the pre applications completion pending resolution of these noted conditions

The next step is the submission of a full, completed Site Plan Application and submission of a Shoreland application.

A Site visit is scheduled for Saturday, May 10, 2008 at 9:00am. Board members assemble at the site. (Note, this visit followings the gravel pit site visit scheduled for 7:30 am.)

ORDINANCE DEVELOPMENT

The Board will hold an ordinance workshop beginning a 6:30 pm at the Town Hall on Wednesday, June 18, 2008
