Lamoine Planning Board

Minutes of November 9, 2010

Chairman J. Holt called the meeting to order at 7:02 pm.

Board Members Present: D. Bamman, G. Donaldson, J. Gallagher, M. Garrett, J. Holt, M. Jordan C. Tadema-Wielandt (7:15 pm)

Minutes of October 5, 2010 . Several minor amendments were offered:

The minutes were approved as amended.

CEO Reports: The CEO's reports were accepted and placed on file.

CONSERVATION COMMISSION

No Commission member was present. No items were offered.

OLD BUSINESS

  1. Request for extension of subdivision construction deadline by Partridge Cove Estates. S. Salsbury (representing the developer, Wayne Wright) stated that if the extension is granted, a water tank for fire suppression would be installed; utility lines would be strung; and the subdivision road completed. G. Donaldson moved and M. Garrett seconded a motion to extend the subdivision permit until December 2, 2011. The motion passed unanimously. 
  2. Site Plan Review/Gravel Extraction Application – D. Gott & Sons, Inc. Completeness Review – Map 3, Lots 6 & 8. Anthony Beardsley, the Town attorney, rendered an opinion that the Board is required to conduct a Site Plan review for both Lots (6 & 8) regardless of previous Board actions on Lot 6.
    1. Site Plan Completeness Review, Map 3, Lots 6 & 8. During discussion of review criteria, the Board notes these listed items as conditions for review completeness.
  3. M. Garrett moved and G. Donaldson seconded a motion to find the application complete once conditions are fulfilled. The vote was unanimous. A Public Hearing on this application is set for December 7, 2010 at 6:30 pm at the Town Hall.

    1. Gravel Extraction Permit Application Completeness Review. Map 3, Lots 6 & 8. Following a discussion of review criteria, M. Garrett moved and J. Gallagher seconded a motion to find the application complete. 4 voted in favor. 1 (Gordon Donaldson) opposed. A Public Hearing on this application is set for December 7, 2010 at 6:45 pm at the Town Hall. Action on both of these applications will be taken at the conclusion of the public hearings.
  4. Site Plan/Gravel Extraction Permit Applications Completeness Review – MacQuinn, Inc, Map 3 Lot 33.
    1. Site Plan Review permit completeness Map 3, Lot 31 & 33. A review of the historical record indicates the Lamoine Planning Board issued a Site Plan Review permit to H. MacQuinn & Sons for these lots by a 4 – 1 vote on October 27, 2004. J. Holt opined that, since the permit application lists only Lot 31, Lot 33 was not included and, therefore, should be subjected to Site Plan Review.

    On May 6, 2008, the Board approved, as a routine renewal, a gravel extraction permit for both lots, considered as one. There was no discussion of a need for Site Plan Review of either lot at the time.

    The two presently sitting Planning Board members (G. Donaldson & M. Garrett) on the Board in 2004 attempted to “reconstruct” the events of the Site Plan Review and Gravel Ordinance applications of 2004. Both agreed the Planning Board “encouraged” these lots be considered as one to facilitate deliberations both at that time and in future. Both agree a Site Plan Review was conducted for both lots being considered as one in 2004.

    The absence of a Site Plan Review for Lot 33 in Town files is a confusing oversight. A copy of these minutes in the file should alleviate the confusion.

    1.   Gravel Extraction Permit Application – Completeness Review. Map 3, Lot 33. Three conditions emerged from the Board's consideration of review criteria. They are:
      1. •  Add a note to the application indicating a lease from Miro.
      2. •  Two access roads (A & B) need to be stated on the application and shown on the map.
      3. •  Include well data on the application.

      J. Gallagher moved to accept the application as complete once the above conditions are met. M. Garrett seconded the motion. The vote was 4 in favor; G. Donaldson opposed.

      G. Donaldson's objections are based on the fact information on applications is unnecessarily confusing. G. Donaldson will draft a new Gravel Permit application.

      Site Walk. A site walk of this property is scheduled for Monday, November 15, 2010 at 9:00am. Walkers are to meet at the entrance to the Cold Spring Water entrance on Mill Road

      Public Hearing. A Public Hearing is scheduled for December 7, 2010 at 7:00 pm at the Town Hall.

NEW BUSINESS

No new business was presented.

OTHER

The Planning Board, as requested by the Town Administrative Assistant, discussed Planning Board and CEO roles regarding inquiries for potential projects. Initial inquiries should be made to the CEO. If a prospective applicant remains interested, he/she should complete a preapplication with which to approach the Board for informal discussion. The Board requires the applicant to have some formal standing (ownership of the parcel of land; a letter of intent to sell/lease from the seller of the land, etc) when appearing before the Board.
