Minutes of March 6, 2012

Planning Board Members Present: Holt, Bamman, Donaldson, Jordan (alt)

  1. Chair Holt called the meeting to order at 7:01 p.m.
  2. Consideration of Minutes

Moved by Jordan (Donaldson) to approve the minutes as written. Approved: 4 - 0

  1. Code Enforcement Officer's Report
    1. Permits Issued - Report accepted by acclamation.
    2. Enforcement Actions - Acting CEO reported that he had inspected the Strum/Cecere violation but was uncertain about whether the violation has been remediated and will consult with CEO Ford.
  2. Conservation Commission: no member present
  3. Old Business - Chair Holt reminded members to sign the mylar for the Alley/Carter permit.
  4. New Business
    1. Completeness review of R.F. Jordan & Sons application for a Gravel Permit (Map 7 Lot 3-2, the former Richard King pit)

S. Salsbury introduced the proposed gravel extraction operation on a 5 acre site lying to the east of a large discontinued gravel pit. Jordan's extraction is on the same site previously permitted to R. King.

The Board reviewed the application packet in light of the requirements and found the two exceptions:

1. contour lines do not extend 100' beyond the boundaries of the proposed extraction site, as required (item #4)

2. no “proof of financial ability to carry out restoration” was present (item #9)

Regarding this second point, a majority of the Board were of the opinion that the absence of a restoration plan and the applicant's agreement to set up and pay into an escrow account did not constitute “proof of financial ability”.

Moved by Holt (Bamman) that the application contains “proof of financial ability”. Motion defeated: 1-3 (Holt, Bamman, Donaldson)

Moved by Donaldson (Jordan) to find the application complete with the two conditions noted above, with the understanding that the applicant will provide the missing information as soon as possible and not later than two weeks prior to the public hearing. Approved: 4-0

    1. Completeness review of R.F. Jordan & Sons application for a Site Plan Permit (Map 7 Lot 3-2, the former Richard King pit)

Holt began by clarifying his understanding that the “site” referred to in the application applies to the 5 acre plot shaded in on the map and that this was the same area to which the Gravel Extraction permit application applied. S. Salsbury stated that this was his understanding as well.

The Board reviewed the application packet for completeness in light of the requirements and found the four exceptions:

        1. Item I-2. No transparent originals were provided;
        2. Item I 4b. No bearings and distances appear on the boundaries to the proposed “site” (the five acre shaded area);
        3. Item I 4e. The Board requested the applicant to include the 2011 updated map of the aquifer and to display on the site map the location of the aquifer in sufficient detail to reveal how proposed extraction operations overlay it;
        4. Item I 5e. No narrative was present describing the current landscaping and buffering in the setback area, particularly on the western boundary along Route 184.

    S. Salsbury agreed to provide the missing information.

    Moved by Holt (Jordan) to find the application complete with the four conditions noted above, with the understanding that the applicant will provide the missing information as soon as possible and not later than two weeks prior to the public hearing. Approved: 4-0

    A site visit was scheduled for March 12 at 3 p.m.

    A public hearing was set for April 3.

  1. Other Public Matters
    1. Chair Holt summarized a letter from the Hancock Planning Board informing the town that they had approved the expansion of the mobile home park at Hancock Heights. This expansion lies above the acquifer serving a portion of Lamoine.
    2. Chair Holt also announced that FEMA will be verifying the boundaries of the Floodplain in Lamoine over the next few months. Coastal residents may encounter FEMA employees performing this work.
  2. Ordinance Matters - The Board scheduled an ordinance workshop for Tuesday March 27 at 6:30 p.m. to continue revising the Lamoine Gravel Ordinance, focusing on:
    1. new buffer strip regulations
    2. new Submission section
    3. revised application
    4. new language on Annual Compliance Inspections and report form
    5. revised Performance Standards

Board members should review revisions that were handed out at the meeting or that will be forwarded by John prior to the meeting.
