Minutes - December 7, 2015

Chair Holt called the regular monthly Planning Board meeting to order at 7:00 PM.

1. Consideration of Minutes of the November 2, 2015 meeting.

P. Fowler advised that notwithstanding the minutes as presented, he was not present at the November meeting. Holt (Bamman) moved to approve the minutes as amended. Approved by VOTE of 5-0.

2. Code Enforcement Officer’s Report

        a. Permits Issued – report accepted

b. Enforcement Issues (4) – Tilden Map 7-lot 29-2 request for consent decree. report accepted.      

 3. Conservation Commission – No report.

 4.  Old Business – None.

 5. New Business – 

a.  Completeness Review for Commercial Building Permit by Brett Jones-Map 4 lot 6-3. The Applicant supplied the names of all abutters as requested at the November meeting, and the Board reviewed the Application. Subsequently, Holt (Bamman) moved to find the Application complete. The VOTE in favor was 5-0. The Applicant was advised that a Commercial Sub-Surface Waste Water (SSWW) Permit must issue before a Building Permit will issue. It was noted that the SSWW Permit Application erroneously identified locus as lot 8, rather than lot 3, which error should be corrected. Public Hearing was scheduled for 6:30pm on January 4, 2016. Holt and Tadema-Wielandt conducted a site visit on November 5.

A discussion about the requirements of Section G of the Site Plan Review Ordinance ensued, after the question was raised about what triggers Site Plan Review.

 

b.   Completeness Review for Commercial Building Permit by S. and R. McMullen-Map 4 lot 21A. Board member R. McMullen recused himself from further discussions. Alternate D. Legere will act on this matter.

The property is an existing residential and commercial use, and is not in a flood hazard zone. The foundation was poured pursuant to a previous, now expired permit, and will be seen during the site visit scheduled for December 12, following those of the two Gott gravel pits (Smith and B & H).

The Board reviewed the Application, noting that Section 3 G 6 of the Building and Land Use Ordinance (BLUO) requires the applicant to provide  sufficient evidence that the proposed use will not affect the quality or quantity of water available to other residents/land owners. Legere (Fowler) moved to find the Application complete. The VOTE in favor was 5-0. Public Hearing was scheduled for 6:30pm on January 4, 2016.

c.   Completeness Review for Gravel Permit by Doug Gott & Sons, Inc.-Map 3 lot 2. (Smith Pit) The property is an existing gravel pit whose permit expired at the end of October, 2015. The Board reviewed the Application, noting that: the parcel location set forth on the Application should be corrected from Douglas Highway to Lamoine Beach Road; data from more than two wells is required for this (12 A.) pit; water elevations differ between the S.W. Cole report and the plan. Tadema-Wielandt (Fowler) moved to find the Application complete with the condition that the above noted corrections be made. The VOTE in favor was 5-0. Public Hearing was scheduled for 6:30pm on January 4, 2016.

d.   Completeness Review for Gravel Permit by Doug Gott & Sons, Inc.-Map 3 lot 6. (B & H Pit) The property is an existing gravel pit whose permit expired at the end of October, 2015. The Board reviewed the Application, noting that it is complete except: the parcel location set forth on the Application should be corrected from Douglas Highway to Lamoine Beach Road; Applicant should clarify which parcel in the deed provided as evidence of its ownership, describes locus; Delineate and describe restoration of the land Westerly of the 50 foot ROW to lot 8 on Map 3 (Stephens lot); data from more than one well is required for this (6 A.) pit; show all setbacks and buffers, including end points for the buffer between locus and the Stephens lot; provide a fully executed copy of the Setback Waiver between locus and the Stephens Pit

Holt (Bamman) moved to find the Application complete with the condition that the above noted corrections be made. The VOTE in favor was 5-0. Public Hearing was scheduled for 6:30pm on January 4, 2016.

e.  Completeness Review for Gravel Permit by Doug Gott & Sons, Inc.-Map 9 lot 7. (Little B & H Pit) The property is an existing gravel pit whose permit expired at the end of October, 2015. The Applicant, through its Agent S. Salsbury, has withdrawn this Application

6. Ordinance Development  -

The question was raised whether the Board should “mine” the recently defeated proposed Gravel Ordinance for possibly useful and/or beneficial ideas/language. It was the consensus of the Board that it might, indeed be useful, but at a future date.

7. Other Business –

Chair Holt presented a draft memorandum which he proposed be distributed to all gravel pit owners and operators, explaining circumstances which require that restoration of certain pits, or portions thereof, be undertaken by the Owner/Operator thereof. Tadema-Wielandt (Bamman) moved that Chair Holt be authorized to send such memorandum as proposed. VOTE in favor was 5-0.

 January 4, 2016, February 1, 2016 and March 7, 2016
