Minutes - August 1, 2016 (Draft, subject to correction)

 

Planning Board Members Present: Holt, Bamman, McMullen, Fowler, Tadema-Wielandt, Gabel-Richards (alt.),

Members of the Press None.

Chair Holt called the regular monthly Planning Board meeting to order at 7:02 PM.

3. Consideration of Minutes of the June 6, 2016 meeting, postponed from the July 11 meeting. Several corrections were suggested, and the minutes were APPROVED 5-0, with the suggested changes. Consideration of Minutes of the July 11, 2016 meeting. The minutes were APPROVED 5-0, after several corrections were made.

4. Code Enforcement Officer’s Report ~

       a. Permits Issued (11+8) ~ Report accepted.

      b. Enforcement Issues (2) ~ Report accepted.

      c. Conditional Permit follow up (4) ~ Report accepted       

 5. Conservation Commission ~ No report.

6. Old Business ~

   a. Marlboro Mist Phase II-illegal subdivision and sale of two unapproved lots. The  11-lot subdivision was approved by the then Planning Board in October of 2004. In  November of 2011, Michael and Lynne Duquette purchased the Northerly portion of lot 11 from the original developer, Sarjoy, Inc., and constructed a residence thereon. Kenneth and Pamela Hoogerhyde, owners of lot 5, purchased the Southerly portion of lot 11 (adjoining their lot 5)  from Sarjoy in May of 2016, and sought a permit to construct a garage on said new lot. The CEO refused to issue a permit for the planned garage, as it is too close to the lot line between lots 5 and Hoogerhyde’s portion of lot 11. Chair Holt has asked the Assessors how they have assessed two halves of one approved lot. There has been no response. Inasmuch as Sarjoy, Inc. has refused to file for a revision to the subdivision plan, Hoogerhydes have done so, and at this meeting, this Board will determine whether that application is complete. The Application Review Checklist was gone over and discussed by the Board members, and it was; MOVED by P. Fowler (Bamman) that the Application is complete, and so VOTED (4-0-1).

     There will be public hearing, and a special Board meeting on Monday, August 22 at 7 pm to vote on this application. There was then a discussion of what, exactly constitutes a “subdivision. Tadema-Wielandt raised the issue that neither half of former lot 11 has adequate frontage on Misty Way. Chair Holt was authorized by the Board (5-0) to advise the Selectboard of this issue.

 b. Chair Holt  requested that CEO Gallegos send Notices of Violation to the following gravel pit owners for expired permits, and the need for Ordinance mandated restoration:
