Planning Board Minutes - May 1, 2017 (Draft, subject to correction)

 

Planning Board Members

Present: Holt, Bamman, Fowler, McMullen, Tadema-Wielandt, Legere (alt.), and Gabel-Richards (alt)

Code Enforcement Officer Present: R. Gallegos

Members of the Public: Steve Salsbury, H. Griff Fenton, Wayne Alley, Burnie Gordon

Members of the Press:  None.

Chair Holt called the regular monthly Planning Board meeting to order at 7:03 PM.

1.  Consideration of Minutes of the February 6, 2017 meeting, upon MOTION by Holt (Fowler), the minutes were APPROVED 5-0.

Consideration of Minutes of the April 3, 2017 meeting, upon MOTION by Holt (Bamman), the minutes were APPROVED 5-0.

2. Code Enforcement Officer’s Report ~

    a. Permits Issued (7+3) ~ Report accepted.

    b. Enforcement Issues (5) ~ Report accepted.

The March 21 complaint regarding Map 16, lot 23 is being addressed by the CEO.  

3. Review of 3/20/17 Permit Conditions Tracking Report ~

            9 items listed, a Complaint has been received by the CEO for failure to complete required restoration of the Little B & H Pit by Doug Gott and Sons.

Also missing required annual reports from Gott for the Alexander, Deerworldz and Davis Pits. Tadema-Wielandt opined that the Board ought not consider any Applications from Gott until all required but incomplete work has been finished, and indicated that he may so move when it is applicable.        

4. Conservation Commission ~ No report.

5.  Old Business ~

a. Gravel Permit Application by HORPLand, LLC (Map 7, lots 13 and 24) Butler Pit. No Application has yet been filed.

6 New Business ~

Bamman requested that the Board consider the Application of Wayne Alley prior to proceeding with the Completeness Review of the three gravel pit applications from Doug Gott & Sons, Inc. Gott Agent S. Salsbury  assented, and the Board proceeded to consider:

 a. Completeness Review of Commercial Building Application by Wayne Alley, (Map 7, lot 4-1) to construct a Commercial Building u/2000 sq. ft. for storage, to replace two existing trailers. After discussion, it was MOVED Tadema-Wielandt (McMullen), and the Board found this Application COMPLETE (5-0) pending receipt from the applicant, of a statement of use and proposed activity.

     The Board then scheduled a site visit for 1 PM. on Thursday, May 4, and a Public Hearing for 6:30 PM on Monday, June 5.

b. Completeness Review of Gravel Permit Applications by Doug Gott & Sons,  Inc. (Map 1, lot 67-1) Alexander Pit, (Map 4, lots 11 and 16) Davis Pit, and (Map 1, lot 70) Deerworldz Pit.

Chair Holt complained that the S.W. Cole report contains too much data whis not applicable to the instant Application, thus it can be confusing and unnecessarily time consuming, and it is unclear which monitoring wells provide data for #s a8, b8 and c8. Fowler pointed out that for completeness purposes, all of the required data is present. Holt furthermore pointed out that because there is no longer an active gravel operation on Map 1, lot 58 owned by the Town, the letter of permission from the Selectboard Chair no longer meets the requirement set forth in Section 8-A of the Ordinance. Legere inquired of a set back waiver with Map 1, lot 75. Salsbury conceded there is none. Subsequently, it was MOVED Holt (Tadema-Wielandt), and the Board found this Application INCOMPLETE (4-1).

c. CEO Gallegos requested that the Board visit the Lorimer Road site, Map 16, lot 27, which is the subject of a SZO complaint, so that it (the Board) may advise him whether he may issue a Permit for reconstruction of the demolished structure on the previously existing foundation. The visit was scheduled for 6 PM on Tuesday, May 2.

7.  Permit Conditions Tracking Report~See appended report.

8. Ordinance Development ~ Shoreland Zoning Ordinance (SZO)

     Holt and Legere have not yet met.

9. Future Regular Meetings ~ July 10, August 1, 2017.

Future Special Meetings ~ May 22, 2017 (SZO) and June 12 2017 (MacQuinn)
