Minutes - August 7, 2017 (Draft, subject to correction)

In Attendance:

Planning Board Members: Holt, Bamman, Fowler, McMullen, Legere (alt.), and Gabel-Richards (alt.)

Code Enforcement Officer: R. Gallegos

Members of the Public: Mike Jordan, Brett Jones.

Chair Holt called the meeting to order at 7:04 pm.

  1. Consideration of July minutes postponed until September meeting, not available.
  2. Code Enforcement Officers Report
    1. Permits Issued - 11. Report accepted.
    2. Plumbing Permits issued - 13. Report accepted.
    3. Report of Enforcement Issues - 5 issues. Chair requested that CEO have Stu remove the first two (Gordon and Liberty) from the list as resolved. Chair requested that two “failure to restore” complaints (Map 7 Lot 3-2 and Map 9 Lot 7) be addressed during New Business.
  1. Conservation Commission: no report.
  2. Old Business:  none.
  3. New Business:

Permit Conditions Tracking Report as of August 1. Six items listed.

a.    King Pit, Map7/Lot 3-2, PCJ/LLC - failure to restore. Discussion of complaint history, actions taken, next steps, and board’ enforcement authority. Motion by Holt (Bamman) to have CEO issue a stop work order except as needed to complete restoration. Work to be completed by September 30, 2017. If work is not completed, the Planning Board will submit to the Selectmen a request for revocation of permit. A revocation of permit would trigger a one year deadline for restoration of entire pit. Motion passed 5 - 0.

b.    Little B&H Pit, Map 9 / Lot 7, Doug Gott & Sons - failure to restore. Discussion about status of non-compliant materials stored on site that the CEO requested be removed. The Board asked the CEO to request an affidavit from Doug Gott & Sons stating that the material was removed.

c.    Asher Pit, Harold MacQuinn, Inc. Board asked CEO to notify MacQuinn that restoration does not meet requirements of ordinance and must be redone by September 30, 2017. The slope requirement will be waived, but the ordinance requires the addition of topsoil and the planting of native grasses.

6. Ordinance Development:

a.    Extensive discussion of Lot Standards & Structure Setback Table, especially the section Minimum Lot Public Road Frontage (ft.). Motion made by Holt (Bamman) to amend footnote 3 to read, “ A dwelling unit or principal structure located within 200 feet of a Public Roadway, and accessed from the Public Roadway, must have a minimum of 200 feet of frontage on that roadway.” Motion passed 5 - 0.

b.    Shoreland Zoning Ordinance - draft 4 by Holt was distributed as well as comments by Mike Jordan. Members asked to read through and compare with state Ordinance for accuracy and compliance.

    7. Election of Officers:

  1. Motion made by Fowler (Legere) to nominate Gabel-Richards as secretary. Motion passed 5 - 0.
  2. Chair and Vice-Chair to remain the same.

    8. Meeting Dates:

     a. Regular: September 11, October 2.

     b. Special (Kittredge Pit expansion):

      1. Site walk - September 14, at 3:00 pm.
      2. Public Hearing - September 27, 6:30 pm at Lamoine School
      3. Special Meeting - October 10, 7:00 pm at Town Hall.
