Chair Holt called the regular monthly Planning Board meeting to order at 7:05 PM.
1. Consideration of Minutes of the December 5, 2016 meeting. Except for correction of spelling of “Gable-Richards”, upon MOTION by Holt (Gable-Richards),
the minutes were APPROVED 5-0.
2. Code Enforcement Officer’s Report ~
a. Permits Issued (3+3) ~ Report accepted.
b. Enforcement Issues (6) ~ Report accepted

4. Conservation Commission ~ No report.
5. Old Business ~
a. Complaint vs. Sarjoy, Inc.~No report from Town Attorney.
b. Findings of Fact & Decision~Application by Harold MacQuinn, Inc. for Gravel Permit for the Asher Pit (Map 3, lots 42 and 43-1) After full review and consideration at the December 5th meeting, the Board voted to table a decision on this Application until the January 9th meeting, approval to be conditioned upon recording of a reclamation plan at the Hancock County Registry of Deeds in accordance with Section 8 (D) 2. S. Salsbury provided the Board with a copy of the required Notice of Intent to Restore a Gravel Pit… as recorded at said Registry of Deeds. Notwithstanding concerns about the steepness of the areas to be restored, and the materials to be used therefore expressed by Legere (written memo appended), the Conditional Approval voted at the December 5th meeting has become Final.
c. Findings of Fact & Decision~Application by Harold MacQuinn, Inc. for Gravel Permit for the Beal Pit (Map 7, lot 9) After full review and consideration at the December 5th meeting, the Board voted to table a decision on this Application until the January 9th meeting, approval to be conditioned upon filing by the Applicant of a revised plan showing the required 100 foot buffer along the boundary between the Beal Pit and land of HORPland (Map 7, lot 24). A new plan submitted by S. Salsbury is still inaccurate, since it incorrectly represents the currently active permitted pit area on abutting Lot 24 on Map 7. Board member Fowler, who had recused himself from consideration of this Application, the operator of the adjoining pit expressed concern over expansion of his active pit area, and has not yet filed his Application therefore. Chair Holt suggested that the Applicant (MacQuinn) withdraw this application and submit a new one, S. Salsbury, the Applicants agent, declined to do so. No permit was issued.
6. New Business ~
a. Application by Ronald Simons to amend the Pine Grove Estates Subdivision. The Applicants agent, S. Salsbury provided a complete Application which the Board reviewed in light of applicable sections of the Building and Land Use Ordinance, and found the Application complete. A site visit was scheduled for January 13th at 9AM. A Public Hearing was scheduled for February 6th at 6:30PM at the Lamoine Town Hall.
b. With regard to the settlement agreement between Harold MacQuinn, Inc. and the Town, the Board discussed the holding of a Special Meeting to consider a new Gravel Permit Application for expansion of the Kittredge Pit (Map 31 and 33).No such Application has yet been filed. Prior to that eventuality, all Board Members except Chair Holt, who has agreed to recuse himself from consideration of such new Application, will need to have copies of the previously filed site plan, and the Gravel Ordinance in effect at the time the previous Application was filed (September 17, 2012). Board members expressed a willingness to hold such a Special Meeting, but suggested that a Monday evening is preferred by all mem,bers to assure full Board member attendance and participation. K. Gaianguest inquired whether the new Application and the applicable iteration of the Gravel Ordinance will be available to the public prior to the scheduled hearing. Chair Holt assured her that they would be.
7. A Public Hearing was scheduled for January 23, 2017 at 6:30PM on the revised Table of Land Uses, and a workshop was scheduled for the same date to discuss necessary revisions to the Shoreland Zoning Ordinance.
8. Future Meetings ~ March 6, April 3, and May 1, 2017.
