MINUTES OF THE LAMOINE PLANNING BOARD

                                                      OCTOBER 9, 2001

                               

D. Coleman called the meeting to order at 7:01pm.

Present were: Planning Board members D. Coleman, P. Fowler, M.A. Orzel, D. Smallidge, J. Bragdon, G. Donaldson, M. Garrett; Deputy Code Enforcement Officer John Larson, Administrative Assistant Stu Marckoon and members of public Steve Salsbury, Reggie McDevitt, John Hubbard, Mike Woodard, Tim Whitney, Denise Barbieri, Susan Wuorinen, Jim tower, Carol Korty, Megan Jaegerman, Steve Joy, Greg Smith and Chris and Lynda Tadema-Wielandt.

Moment of Silence – D. Coleman asked all members present for a moment of silence in remembrance of former Planning Board secretary Karen (Crawford) Eaton, who passed away last week.

Minutes – The minutes of September 11, 2001 were accepted as written.

Code Enforcement Officer’s Report – Listings of monthly permits issued and a ‘tracking update’ of Ordinance Enforcement Issues were presented and placed on file.

Old Business

1.      Gravel Pit Permit Renewal for McDevitt/RF Jordan, Map 3, Lot 4. The permit is approved with three listed ‘conditions’.

a)     With prior notification to the owner or designee, the CEO alone or with one or more members of the Planning Board, may visit the site upon request.

b)     From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well for a period of two years failing which, additional restoration will be performed.

c)      Monitoring well(s) will be checked in April and November of each year.

M. Garret moved permit approval with conditions. Unanimously voted upon.

2.      Gravel Pit Permit Renewal for John W. Goodwin, Jr. Map 1, Lot 75 (sic.). The permit is approved with three listed ‘conditions’.

a)     With prior notification to  the owner or designee, the CEO alone or with one or more members of the Planning Board, may visit the site upon request.

b)     From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well for a period of two years failing which, additional restoration will be performed.

c)      Monitoring well(s) will be checked in April and November of each year.

M. Garret moved the permit be approved with conditions. D. Smallidge seconded. The motion passed unanimously. Passed also was a motion to table until November, a Site Plan Review.

3.      Gravel Pit Permit Renewal for John W. Goodwin, Map 4, Lot 41-1. The permit is approved with three listed ‘conditions’

a)     With prior notification to the owner or designee, the CEO alone or with one or more members of the Planning Board, may visit the site upon request.

b)     From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well for a period of two years failing which, additional restoration will be performed.

c)      Monitoring well(s) will be checked in April and November of each year.

A motion was made to grant the permit with conditions and to table Site Plan Review until November. The motion passed unanimously.  Passed also was a motion to table until November, a Site Plan Review.

4.      Commercial Building Permit/Site Plan Review – Carlton Johnson, Map3, Lot 25-1

The Site Review pre-application is deemed incomplete. The following information must be provided before further consideration is rendered.

a)     A design for roadways and parking areas.

b)     The number of cars and/or boats to be stored on the premises.

c)     A statement regarding water access for fire protection.

d)     A statement concerning toxic waste, including the maximum amount of fuel on the premises at any given time, where it is stored and how the waste is disposed.

e)     A plan for screening the site from public view, said plan to include planting of trees at least six feet in height.

f)       A display of ground floor elevations to include elevations from the ground floor to the peak of existing and proposed structures.

          

5.      Subdivision Permit – Stuwe/Woodard, Map 1, Lot 23.

G. Donaldson moved to accept the subdivision permit. M.A. Orzel seconded the motion. The motion was unanimously rejected. The following information is needed to complete the application.

a)     A list of property owners across the Shore Road from the development.

b)     A written determination attesting to the fact property slopes fall within the range of 1% to 5% required by the ordinance. The burden is upon the developer to either obtain written testimony to this effect from a surveyor or have drawn a topographical map.

The Board further stipulated that if the above information is found by the Chairman and/or Vice Chairman of the Board to be complete and accurate, the application will be deemed complete, and a public hearing scheduled for the next meeting, November 13, 2001.

6.      Gravel Pit Permit/Expansion & Site Plan Review. Gott/Neleski, Map 1, Lot 70; Map 4,

Lots 11 and 16.

      These three lots are to be combined into a single permit for Site Plan Review. Before further consideration is granted, these listed ‘conditions’ need be met.

a)     A delineation of a restoration plan for the next three years.

b)     A portrayal of those areas which will not be disturbed.

c)     A copy of the deeds for Map 4, Lots 11 & 16.

d)     Contour lines on Map 4, Lot 11 (the Davis Pit).

e)     A schedule of extraction, including proposed beginning and ending dates.

f)       An estimate of the number of trucks entering and leaving each day.

g)     Consideration for planting vegetative screening.

New Business

1. Gravel Pit Permit Renewals – Harold MacQuinn, Inc. Map 7, Lots 7 & 9; Map 3, Lot 42.      

In order to review these applications for completeness at the November meeting, the  following information is needed.

a)     An extension of mapped contour lines.

b)     The names of abutters placed on the maps.

c)      A marking of test wells on the maps.

d)     An assurance test well will be monitored in April and November of each year.

e)     Map 3, Lot 42 (The Asher Pit). There is serious Board concern about that portion of this mined pit which falls within the Shoreland Zone and that portion which borders the road. Steps must be taken to restore vegetation to land within the Shoreland Zone and to stabilize (i.e. to vegetate) the bank near the road.

              Available members of the Board will assemble at the Town Hall at 7:00am on Saturday, October 20th for an on site tour of these lots.

           2. Subdivision Pre Application – Steve Joy/Barton Weilburg, Map 4, Lot 46.

                     Proposed is a ten or eleven lot subdivision on this 40 (+/-) acre lot on Needles

Eye Road. Available Board members will assemble at the Town Hall at 8:00am on Saturday, October 27th for an on site tour.

Other Business

1.      Septic Permit in Shoreland Zone. W. Lawrence, Map 1, Lot 43-1.

The CEO has approved this septic system permit, as did the Board with a unanimous vote moved by G. Donaldson, seconded by P. Fowler.

2.      The Aquifer Map. The long awaited Aquifer Map.

       M.A. Orzel unveiled the long awaited and much heralded Aquifer Map which serves as the basis for defining the Aquifer Zone. Congratulations were offered to Mary Ann and to Joan Bragdon for their diligence in pursuit of this map.

     M.A. Orzel is authorized to call Mr. Gerber and determine what information we might seek to assess Lamoine’s water supply by a town canvass of operating wells.

3.      A meeting (a final one?) to put in final form the proposed Building and Land Use Code will be held at Town Hall, 7:00pm on October 30th.

4.      The November Planning Board Meeting is November 13th at 7:00pm

Saturday, October 27th – Site Visit, the Needles Road proposed subdivision. Meet at 8:00 at the

Tuesday, October 30th – A workshop to make “final” revisions to the Building and Land Use Code.
