Minutes of the Lamoine Planning Board

NOVEMBER 13, 2001

 

Chairman Coleman called the meeting to order at 7:00pm.

Minutes – The October 9, 2001 minutes were adopted with these listed amendments.

1.       Under Old Business, items 1,2 & 3. Item letter a) should read on all: “With prior notification to the owner or designee, the CEO alone or with one or more members of the Planning Board may visit the site upon request.”

2.       Under Old Business, items 1,2, &, 3. Item letter b) should read on all: “From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well for a period of two years failing which additional restoration will be performed.”

3.       Under Old Business, item 2. The referenced lot should read: Map 1, Lot 71

4.       Under Old Business, item 3. The reference lot should read: Map 4, Lot 41 –1. While the permit was approved, the Site Review Plan was tabled until the November meeting. The tabling is not reflected in the minutes of October 9, 2001

5.       Under Other Business, item 4. The November Planning Board meeting, etc.

Code Enforcement Officer’s Report.

 

1.       The monthly report of permits was accepted and placed on file.

2.       J. Holdsworth stated the Ordinance language regarding permitted temporary occupation (30 days) of mobile homes on a lot is confusing. Is it possible a mobile homeowner could simply unplug and re plug utilities and thereby begin a new 30-day cycle. The Board will consider this matter at a future meeting.

Public Hearing & Action – Subdivision (Stuwe/Woodward, Map 1, Lot 23)

As no public testimony was offered, the hearing was closed shortly after being called. D. Smallidge moved, and P. Fowler seconded approval of the permit.

Gravel Pit – John W. Goodwin (Map 4, Lot 41-1) –

            The permit was approved at the October Planning Board meeting.

Site Plan Review – John W. Goodwin (Map 1, Lot 75, Map 4, Lot 41-1) –

            There is a good deal of confusion about the application, including mislabeling and omissions.

1.       Map 4, Lot 41-1.

a.        Exhibit F should properly be labeled Exhibit D.

b.       Exhibit G, the aquifer map, is missing

c.       The applicant needs to indicate the increment of expansion over the next ten years and calculate and pay the fee (five cents a square foot) prior to approval)

           

2.       Map 1, Lot 71 – The Site Plan Review application is not complete, including a calculation of estimated expansion and payment of the required fee.

Grave Permit – Harold MacQuinn, Inc. (Map 3, Lot 42, Map 7, Lots 7 & 9)

           

1.       Map 3, Lot 42 – The “Asher” Pit. A motion for application completeness was moved by D. Smallidge, seconded by J. Bragdon and unanimously passed. A motion to approve permit application with these listed conditions was made by M.A. Orzel, seconded by D. Smallidge and passed unanimously. The conditions are:

a)       With notification to the owner or designee, the CEO alone or with one or more members of the Planning Board, may visit the site upon request.

b)       From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well after two years, failing which additional restoration will be performed.

c)       Monitoring wells will be checked in April and November of each year.

d)       The west (shore land) bank will be restored (removing some of the ridge top) and re-graded.

e)       The monitoring well will be relocated.

f)         The east bank (abutting Route 184) does not meet the grade required by the ordinance. Erosion is evident. The grade of this slope is to be lessened and plantings made.

2.       Map 7, Lot 9 – The “Beal” Pit. A motion for completeness was made by D. Smallidge, seconded by J.  Bragdon and unanimously approved. A motion to approve permit application with these listed conditions was made by D. Smallidge, seconded by M. Garrett and unanimously passed. The conditions are:

a) With notification to the owner or designee, the CEO alone or with one or more members of the Planning Board, may visit the site upon request.

b)       From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well after two years, failing which additional restoration will be performed.

c)       Monitoring wells will be checked in April and November of each year.

d)       The south (flat) slope is to be seeded and otherwise restored.

e)       The north slope is to be reseeded and re-graded.

3.       Map 7, Lot 7 – The “Jones” Pit – A motion for completeness was made by D. Smallidge, seconded by J. Bragdon and unanimously approved. A motion to approve permit application with these listed conditions was made by M.A. Orzel, seconded by J. Bragdon and passed unanimously. The conditions are:

a)       With notification to the owner or designee, the CEO alone or with one or more members of the Planning Board may visit the site upon request.

b)       From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well after two years failing which additional restorations will be performed.

c)       Monitoring well(s) will be checked in April and November of each year.

d)       A demonstrable effort will be made to re grade and restore the northwest slope.

e)       The area surrounding the pond will be restored – new grass and some plantings.

In future, because they are situated within 800 feet of each other, the “Beal” pit (Map 7. Lot 9) and the “Jones” pit (Map 7, Lot 7) are to be consider a single pit for purposes of obtaining a permit.

Commercial Building Permit/Site Plan Review – Carleton Johnson

Upon motion of M. Garrett, seconded by P. Fowler, the Board voted to accept the Site Plan Review pre application as being completed once a tax map with lot numbers of abutters is presented. A further condition is that landscaped screen will be completed within one year.

A site visit is scheduled for Saturday morning, November 17th. Available Planning Board members should assemble at the Town Hall at 8:00am. A public hearing will be held at the Board’s December meeting.

Subdivision Pre-application – Steve Joy/B. Weilburg (Map 4 Lot 46) –

A site visit will be conducted at 9:00am on Saturday, November 17, 2001. Noted was the absence from the plan of a test pit on Lot #9

Site Plan Review – Doug Gott % Sons, Inc./W. Neleski Jr. (Map 2 Lot 46) –

                        Since no one was present to represent Gott & Son, no action was taken.

New Business –

Gravel Pit Renewal – J. Aubrey Davis (Map 4, Lot 41)

            D. Smallidge moved, M.A Orzel seconded a motion to accept the application as complete with these stated conditions. The motion was unanimously accepted.

1)       With prior notification to the owner or designee, the CEO alone or with one or more members of the Planning Board, may visit the site upon request.

2)       From the date of final restoration approval, the owner guarantees at least 85% of the restored vegetation will be alive and well after two years, failing which additional restoration will be performed

3)       Monitoring well(s) will be checked in April and November of each year.

4)       A map containing lot numbers of abutters which can be cross-referenced to a list provided by the owner will be submitted.

5)       A statement indicating the amount of gravel extracted during the previous twelve months will be filed.

The date of a site visit will be set and announced.

 

Other Business –

            Chairman Coleman indicated a final draft of the Building and Land Use Ordinance is nearing completion. The draft will be sent to Town officials and other interested parties in the general populace. A letter of transmittal will be posted by Mr. Coleman in the Town offices.

            The tentative schedule calls for written comments to be submitted to Mr. Coleman no later than December 28, 2001. Two informational meetings (Note: not public hearings) will be held, one in January, 2002; a second in February, 2002. Sometime after these meetings, a public hearing will be held. The Ordinance will be put to voters at Town meeting in March.

            D. Smallidge moved and J Bragdon seconded a motion to adjourn. The meeting adjourned at 9:23pm

Dates to Note:

Saturday, November 17th – A site visit to Map 3 Lot 25-1, Carleton Johnson’s project. Available Planning Board members will assemble at the Town Hall at 8:00am and proceed to the site.

Saturday, November 17th - A site visit to Map 4 lot 46, S. Joy/B. Weilburg’s subdivision proposal site. Available Planning Board members will meet on the site (Needle’s Eye Road) at 9:00am.

Tuesday, December 4th – December meeting of the Planning Board. Town Hall. 7:00pm
