MINUTES OF THE LAMOINE PLANNING BOARD
October 7, 2003

INFORMATIONAL HEARING

P. Fowler called the informational meeting to order at 6:47pm. The purpose of the meeting was to inform members of the public and receive comments from them about proposed changes to the Building and Land Use Ordinance. Attendance was sparse, though some comments and suggestions were received. The Board voted to conduct another informational session before (at 6:30pm) its November 4th monthly meeting. The Board also voted to hold a workshop immediately following this meeting to finalize any and all changes to be proposed at the Town Meeting on November 19, 2003.

The informational meeting closed at 7:20pm.


MONTHLY MEETING

Chairman P. Fowler called the meeting to order at 7:22pm.

Minutes: Minutes of the September 2 and September 15, 2003 meetings were accepted as written.

Cod Enforcement Officer’s Reports: The reports were accepted and placed on file.

Conservation Commission: C. Korty spoke about and “advertised” a Conservation Commission panel discussion on development to be held at the Lamoine School on October 8, 2003.


OLD BUSINESS

1. Completeness Review – Subdivision Application by R. Simons/M. Harriman, Map 7, Lot 4, 4-4
G. Donaldson moved and M. Garrett seconded a motion to accept the application as complete with these listed conditions.

a) Payment of the required fee.
b) Map must reflect 8 lots rather than the 12 presently thereon.
c) The names and addresses of two abutting property owners (within 200 feet of the common boundary) must appear on the map.
d) A well driller’s testimony to an adequate water supply needs be provided in the owner’s name (not that of R. King).
e) A description on the map needs to reflect a detailed layout of septic beds, set backs and easements.
f) A statement reflecting the following needs to appear on the Plan map. “Owners of a failed septic system must utilize a second new system in the common septic area before requesting a permit for a replacement system on a lot.”

A public hearing is scheduled for November 4, 2003.

2. Shoreland Zoning Application – A&J Pettegrow, Map 8Lot 12-2. The Board received a letter stating this application will be submitted at the November meeting.

NEW BUSINESS

1. Shoreland Zoning Permit (after the fact), S. Gardner, Map 14, Lot 48. M. Garrett moved, G. Donaldson seconded a motion to accept the application as complete. The motion was defeated by a 0-5 vote. The following items are needed to complete the application:

a) A detailed plot plan showing the names of abutting landowners, boundary line, perimeter footage, all setback measurements, Flood Plain boundary lines and site elevation above the normal high water mark
b) Front and side elevation drawings of proposed (existing) structures.
c) A 1985 photograph showing the deck

2. Septic System in Shoreland Zone, T&V Brennan, Map 12m Lot 13. G. Donaldson moved approval. M. Garrett seconded. The motion carried unanimously.

3. Request from Anthony Belch for subdivision road inspection (Orchard Lane). The Board Commends the Road Commissioner for the thoroughness of this report.


OTHER BUSINESS

The Board recommends the Selectmen address the realtor and the developer of the potentially misleading statement (“Pending final approval, the road in the subdivision will be paved and town-maintained.”) in an advertisement for lots in the Marlboro Wood Subdivision.
