MINUTES OF THE LAMOINE PLANNING BOARD
December 2, 2003

P. Fowler called the meeting to order at 7:02pm.

Minutes: Minutes of the November 4, 2003 meeting were accepted as presented.

Code Enforcement Officers Reports: The reports were accepted and placed on file.

Conservation Commission: Donna Theall was present to represent the Conservation Commission. Commission drafted proposed amendments to the Gravel Ordinance were presented to the Board as was a proposed Lamoine Parks Ordinance. These items were accepted with a pledge to consider them at some point after the Land Use Ordinance changes have either been accepted or put to rest.


OLD BUSINESS

1. Public Hearing re: Shoreland Zoning Application by A&J Pettegrow, (Map 8, Lot 12-2) The hearing was opened. As attorneys for both the Pettegrow’s and the neighbor’s agreed to a postponement, no one spoke at the hearing. The hearing was recessed until the January 6, 2004 meeting. No further action was taken.

2. Completeness Review – Shoreland Zoning Application – Stephen Gardner, (Map 14, Lot 48). As the application was submitted after the deadline for submission and as no one was present to represent
Mr. Gardner, this item was tabled until the January 6, 2004 meeting.

NEW BUSINESS

1. Gravel Permit Renewal Applications – D. Gott & Sons, Inc. (Map 3, Lot 2, Map 3, Lot 2-1, Map 3, Lot 6, Map 7, Lot 9). Each application was considered separately as follows:

a) Map 3, Lot 2. G. Donaldson moved and L. Haft seconded a motion to accept the application as complete subject to the listed conditions.


(1) The Atlantic Landscape Company is to provide a written description of what materials will be used for re vegetation, the specific area(s) to be re vegetated and the time schedule for re vegetation of this pit.
(2) J. Holdsworth is requested to provide T. Gott with the most recent monitor well reading so that this information can be part of a completed application.

b) Map 3, Lot 2-1. L. Haft moved and S. Branch seconded a motion to accept the application as complete subject to the listed condition.


The Atlantic Landscape Company is to provide a written description of what materials will be used for re vegetation, the specific area(s) to be re vegetated and the time schedule for re vegetation of this pit.

c) Map 3, Lot 6. L. Haft moved and S. branch seconded a motion to accept the application as complete subject to these conditions:


(1) The Atlantic Landscape Company is to provide a written description of what materials will be used for re vegetation, the specific area(s) to be re vegetated and the time schedule for re vegetation of this pit.
(2) The map is to be re drawn so that the (blue) working area more accurately reflects anticipated work to be done.
(3) J. Holdsworth is requesteed to provide T. Gott with the most recent monitor well reading so that this information can become part of a completed application.


(d) Map 9, Lot 7. S. Branch moved and G. Donaldson seconded a motion to accept the application as complete subject to these conditions.


(1) The Atlantic Landscape Company is to provide a written description of what materials will be used for re vegetation, the specific area(s) to be re vegetated and the time schedule for re vegetation of this pit.
(2) J. Holdsworth is requested to provide T. Gott with the most recent monitor well reading so that this information can become part of a completed application.
The Board also unanimously agreed that any spilling of hazardous waste sufficient to involve the Department of Environmental Protection must also be reported to the Lamoine CEO.


A Site visit to all four pits is scheduled for Sunday, December 14, 2003. Interested parties are to assemble at the Lamoine Transfer Station at 8:00am.


2. Commercial Building Permit Renewal, D. Gott & Sons, Inc. (Map 6, Lot 6) After receiving assurances that the same conditions applied to the original permit (see Minutes of April2, 2002) apply also to the renewed permit, M. Garrett moved and G. Donaldson seconded a motion to renew the permit. The vote was unanimous.


3. Request of David Sanderson for Lot Division in Eagle Point Subdivision, (Map 21 Lot 6-1) in the Shoreland Zone. After considerable discussion and a search of the Shoreland Zoning Ordinance, the Board concluded it does not have jurisdiction to grant this permit. Rather, permit granting in this instance is more properly placed in the office of the CEO.


OTHER BUSINESS
The Board considered the Town Meeting’s rejection of proposed changes to the Building and Land Use Ordinance. The Board will hold a workshop on January 13, 2004 to further refine the changes and attempt to establish a schedule for another town vote.
