Code Enforcement Officer's Report: Following some discussion about Michael Keene's intention to reactivate or abandon gravel extraction at Map 4, Lot 41 ( the “Aubrey Davis Pit”), M. Garrett was instructed to write a letter to D. Ford. The letter will ask D. Ford to remind M. Keene that regardless of his intentions for the pit, he remains responsible for the restoration plan filed by the previous owner..
The CEO's reports were accepted and placed on file.
Conservation Commission: D. Theall spoke to the Board about the Commission's “second annual” spring road clean up on May 7, 2005.
Subdivision application completeness review. D. Crawford. Map 3, Lot 19. The application was previously deemed incomplete for want of written DEP approval for a stormwater management plan. This information was presented to the Board. In fur the r discussion, the Board seeks assurance that notation of an easement on Lot 8 appears on the plot plan. M. Garrett moved and M. Havey seconded a motion to accept the application as being complete. The vote was unanimous.
A public hearing is scheduled for 6:30pm on May 2, 2005 .
Septic Systems under road in the Bar Harbor Heights subdivision. Upon verbal advice of the Town
Attorney, the Board has no jurisdiction in the matter. There remains concern about the legal legitimacy of J. Ploszaj's proposed septic system placement on Map 14, Lot 56. A state inspection is pending.
Does the permit need to be renewed? H. MacQuinn, Map 3, Lot 33. The Board recently completed a
Site Plan review of Map 3, Lot 33 – an expansion of the pit on Map 3, lot 33. The question is: Does H MacQuinn need to renew his permit for Map 3, Lot 33 when it expires? The Board determined that Map 3, Lot 33 was included in the Site Plan Review of the pit expansion and need not be subject to a separate review, including a permit fee which was paid as part of the expansion. Henceforth the pit(s) will be considered as a single entity, the permit expiration date of which coincides with the permit approval date of Map 3, Lot 31 ( the “Miro” Pit).
Request for Home Occupation. T. Simons, Map 7, Lot 4-4. As several pieces of information were lacking on the application, M. Simons was requested to “fill in the blanks” and return with a complete application. The application should include drawings showing lot dimensions, set backs, proposed parking and signs.
Modification to Construction Permit Application. M. Havey moved and C. Ohmart seconded a motion to adopt modifications to the Lamoine Construction Permit Application. The modification consisted of inserting the new fee schedule adopted at Town Meeting on March 9, 2005
T. Stephenson's inquiry about a proposed lot sale. Map 10 Lot 7-1. Two years ago, T. Stephenson purchase a lot on Woodcock Lane . Recently, he sold a ten acre portion of it. He now proposes to divide and sell ano the r 8 acre parcel with a 500 foot plus easement for driveway access to Mud Creek Road . The Board determined his proposal constitutes a subdivision according to the Ordinance. He needs a subdivision permit to continue.
Corrections to the Building and Land Use Ordinance. The Board approved corrections of mistakes inadvertently made over the course of the two plus years and multiple drafts during which changes were being finalized. The Board also requested S. Marckoon to re number the Table of Land Uses in such a way as to eliminate the “A” in the line labeled “22A”' and properly alphabetize items the re on.
Appeals Board Ordinance. With changes to the BLUO completed and the Pettegrow appeal heard, the Board seeks to “revive” efforts to secure passage of an Appeals Board Ordinance, previously presented. M. Garrett will request that Appeal's Board to again look at the proposed ordinance and make whatever suggestions it deems appropriate. No time table is set for presenting the ordinance to the Town.
The Chairman noted the Planning Board is two Alternate members shy of full membership. Interested parties are urged to express a willingness to serve to S. Marckoon prior to an April 14 th meeting of the Selectmen.
