Lamoine Planning Board Minutes October 3, 2006

Chairman Branch called the meeting to order at 7:02pm

Minutes: Three corrections were offered to the minutes of September 5, 2006 . In ‘Board Members Present' and in two places, M. Gallagher was corrected to read C. Gallagher. In Item 1 under New Business, M. Garrett moved rather than M. Garrett voted. The minutes were then accepted as amended.

CEO Reports: Reports from the CEO were accepted and placed on file.


1. Subdivision Application Completeness Review – Sno-Drum LLC, Map 3, Lot 27. The Board reviewed information requested of the applicant at the September meeting. Following this review, M. Garrett moved and C. Ohmart seconded a motion to read: “The application is deemed incomplete pending the submission to the CEO of two Permits By Rule – one for a stream crossing; the other for storm water management.” The vote in favor of the motion was 5 – 0.

Site Plan Review – Sno-Drum LLC, Map 3, Lot 27. G. Donaldson moved and S. Branch seconded a motion to accept find the Site Plan Review application complete . The motion was defeated by a vote of none in favor; five opposed, for the se listed reasons:

For the record, C. Ohmart is very concerned about issues of safety stemming from the junction of the subdivision road and Shore Road and its proximity to Rt. 184. J. Holt contends some of the survey data on the developer's plans may not be accurate. Both of these issues will be addressed at a public hearing yet to be scheduled.

2. Subdivision Pre-application, W. Wright/S. Salsbury, Map 4, Lot 34. As no one appeared on behalf of this project, the Board took no action.


1. Home Occupation Request – C. Weber, Map 3, Lot 28. C. Weber has a building permit to construct a greenhouse on his property. He seeks a Home Occupation permit to allow him to grow vegetables in the greenhouse for sale to various outlets in and around Lamoine. G. Donaldson moved and M. Garrett seconded a motion to grant the permit. The motion carried 5 – 0. Mr. Weber was cautioned that at some point, the addition of more greenhouses could trigger a need for a Site Plan Review and potential requirement of a Commercial Permit.

2. Shoreland Zone Request – N. Fenton, Map 16, Lot 20A. Though the current Ordinance does not permit the driveway requested, G. Donaldson moved and M. Havey seconded a motion to approve the “driveway” IF N. Fenton meets the requirements for a “ Private Way ” defined in proposed changes to the Shoreland Zoning Ordinance. Those requirements are:


The Board scheduled the se two dates for readying the Shoreland Zoning Ordinance for a Town Meeting vote in March:

Tuesday, November 21, 2006 . Public Information Hearing. Town Hall. 7:00 PM. (Note: Board members are to convene at 6:30 pm to “organize” the presentation.)
