 Minutes - March 15, 2016

Chairman Gary McFarland called the meeting to order at 6:02 PM.

Present were: Selectmen Robert Christie, Gary McFarland, Kathleen Rybarz, S. Josephine Cooper; Administrative Assistant Stu Marckoon, Kathleen DeFusco, town attorney Diane O’Connell and Mike Wight. Selectman Heather Fowler had contacted the town office prior to the meeting to say she was unable to attend.

Broughman Builders – House too close to road. – Jo moved to enter an executive session pursuant to 1MRSA 405(6)(E) in order to discuss a legal matter with the town attorney.  Gary 2nd.  Vote in favor was 4-0 at 6:03 PM. (Mrs. DeFusco left the meeting) Out at 6:42 PM.

Mr. Wight appeared at the meeting.  Gary said the Board had been speaking with the town attorney (Mrs. O’Connell) in this matter and is pursuing a consent agreement.  He said each agreement is unique, and the board discussed various items to contain in the agreement.  Jo said the board will ask the attorney to draft an agreement, nothing is written in stone.  Gary said the Code Enforcement Officer had re-measured the distances of the house from Douglas Highway.  He said the Board’s proposed agreement would include provisions that the house could remain in its present location, but fencing or screening would have to be planted, the driveway/parking area would have to be on the north side or behind the house, not between the home and Douglas Highway, there would be a fine, and attorney fees that would be imposed.  Mr. Wight said he would like to know a rough number on the fine.  The board said they were thinking $50/day from the date the violation notice was issued to tonight, or approximately $3,450.  Mr. Wight said the fine was a little steep but seemed acceptable. Mr. Wight left the meeting

Gary moved to enter executive session pursuant to 1MRSA 405(6)(E) to further confer with the town attorney on this matter.  Jo 2nd.  Vote in favor was 4-0 at 6:55 PM.  Out at 6:59 PM.

Jo moved to authorize the town attorney to draw up a consent agreement, subject to board approval.  Bob 2nd.  Vote in favor was 4-0.

There being no further business, the meeting adjourned at 7:00 PM
