April 2005 Amendments correcting Building and Land Use Ordinance

 

 

Be it enacted by the Town of Lamoine at a properly held town meeting that the following amendments are made to the Building and Land Use Ordinance amended on March 9, 2005, the purpose of which is to correct errors and make clarification to the ordinance:

 

  1. Section H – Table of Land Uses – Line 22A-33 – Renumber rows so that numeric numbering is also alphabetical (see table on next page)
  2. Section H – Table of Land UsesLine 23: Delete “automobile graveyards”
  3. Section H – Table of Land Uses – Line 24 (Now line 25): Add “automobile graveyards”
  4. Section H – Table of Land Uses – Line 27 (Now Line 28): Restore to read Shops, Automobile Repair.  (not allowed in residential zone, planning board approval required in development and rural and agricultural zones)
  5. Section H – Table of Land Uses – Line 28:  Delete this line – and renumber lines that follow
  6. Section H – Table of Land Uses – Line 30 (after item 1 above, this now becomes 29): Clarify that CEO approval is needed for Signs in all zones. 
  7. Section I – Footnote 6 – renumber this to read footnote “5” and change the reference in the Maximum Building Height column to show footnote “5”.
  8. Section 12 D (4) (b)  - confirm that the word “and” was to be stricken in the 2nd sentence following the words “Part E”.
  9. Section 12 E 14 – confirm that the section reference should read “12-I”, deleting the reference to “12 D 4”.
  10. Section 12 G (5) (d) – The word “shall” is eliminated from the beginning of sections ii, iii, and iv.
  11. Section 12 I (4)clarify that this is superseded by passage of the fire protection amendments.
  12. Section 14 (E)(3)(b) – Change the word “or” to “of” in the phrase that presently reads “setbacks and side and rear yard widths or all structures”.
  13. Section 14 (F)(12) – Change the word “doubt” in the first sentence to “doubts”.
  14. Section 16  - Confirm that former sections 15, 16, and 17 are re-numbered to reflect added section 15.
  15. Now Section 17 – Add clarification that the effective dates are as follow:
